Field & Proof

The founding service

Terms of Service

Effective September 1, 2026 · Last updated September 1, 2026

These Terms govern purchases from and use of Field & Proof. Field & Proof is operated by Chris Garcia as a sole proprietor in Texas. By purchasing the service or submitting an intake, you agree to these Terms and acknowledge the Privacy Policy.

1. Eligibility

You must be at least 18 years old and legally able to enter into an agreement. If you submit information for a business or another person, you confirm that you have authority to do so and the right to share the submitted materials.

2. The founding service

The current founding offer is a one-time, manually prepared written business analysis for an operating side hustle or small online business. The customer submits information about the offer, activity, results, and relevant evidence. Field & Proof reviews that evidence to explain what is most likely keeping the business from moving forward, what remains uncertain, and one clear next step with a focused test.

The service includes one written analysis; delivery by email within three business days after a complete intake unless a different date is communicated; one optional 20-minute report review; and one seven-day execution check-in.

The service does not include implementation, ongoing coaching, business management, legal review, tax advice, investment advice, medical or mental-health advice, or a guarantee of revenue or any other business outcome.

3. Price and payment

The founding price is a one-time payment of $39, unless a different price is clearly displayed before purchase. This is not a subscription. Payment is processed by a third-party payment provider. You agree to provide accurate payment and contact information and authorize the displayed charge.

4. Intake and customer responsibilities

The delivery period begins after a complete intake is submitted. A response of “unknown” or “not tracked” may be complete when the information is genuinely unavailable. Field & Proof may ask a limited clarification question when a missing or contradictory fact could materially change the analysis.

You agree to provide information that is accurate to the best of your knowledge; share only materials you own or have permission to provide; remove identifying customer details where they are not necessary; use view-only links where possible; and avoid submitting passwords, private customer data, government identification numbers, complete financial-account information, medical information, malware, unlawful content, or anything you do not have the right to share.

Field & Proof may decline unsafe, unlawful, clearly out-of-scope, or materially incomplete submissions. If the service is declined before analysis begins, the payment will be refunded.

5. Delivery and customer decisions

The analysis is limited to the evidence supplied and may state that the evidence is insufficient to support a strong conclusion. Business conditions can change, and reasonable people may interpret limited evidence differently.

You remain solely responsible for business, financial, operational, and legal decisions. Field & Proof does not act as your agent, employee, attorney, accountant, investment adviser, fiduciary, or business operator.

6. Refunds and clarity guarantee

  • Not a fit: If the intake shows that the service is clearly not appropriate, Field & Proof will stop before analysis and refund the payment.
  • Late delivery: If delivery will take more than five business days after a complete intake, you may choose a refund instead of delayed delivery.
  • Clarity guarantee: If the delivered analysis does not clearly explain what is most likely limiting progress, the supporting evidence, important uncertainty, and a test you can execute, contact us and Field & Proof will revise the unclear or missing element. If the revision still does not provide those elements, Field & Proof will refund the payment.

Other refund requests may be submitted to [email protected] and will be reviewed promptly based on the work completed, the circumstances, these Terms, and applicable law. Approved refunds are returned to the original payment method; processing time is controlled by the payment provider and financial institutions.

7. Customer materials and report use

You retain ownership of materials you submit. You grant Field & Proof limited permission to access, review, copy, and process those materials only as reasonably needed to provide the service, operate the business, enforce these Terms, and use anonymized or aggregated patterns as described in the Privacy Policy and applicable consent.

After full payment, you may use the delivered report for your own personal or internal business purposes and may share it with your employees or professional advisers. You may not resell, publish, license, or present the report or Field & Proof methodology as your own commercial product without written permission. Your underlying business information remains yours.

8. Confidentiality and third-party services

Field & Proof will use reasonable care with nonpublic customer materials. Absolute confidentiality or security cannot be guaranteed, particularly for links or platforms controlled by third parties. Checkout, forms, email, hosting, and other functions rely on third-party providers subject to their own terms and privacy practices.

9. No guaranteed outcome

Field & Proof provides an evidence-based educational service, not a promised result. To the maximum extent permitted by law, the service is provided without warranties of revenue, profitability, market demand, customer response, uninterrupted availability, or fitness for a particular business decision.

10. Limitation of liability

To the maximum extent permitted by law, Field & Proof and Chris Garcia will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the service or a customer’s business decisions. For claims directly related to a purchased service, total liability will not exceed the amount the customer paid for that service. These limitations do not apply where applicable law does not allow them.

11. Suspension or refusal of service

Field & Proof may suspend or refuse service for unlawful use, threats, abuse, fraud, payment disputes, security risks, or material violation of these Terms. If service is refused for reasons unrelated to customer misconduct before the analysis begins, the unearned payment will be refunded.

12. Governing law and informal resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Before filing a legal claim, you and Field & Proof agree to make a good-faith effort to resolve the issue by email for at least 30 days, unless immediate action is reasonably necessary or applicable law provides otherwise.

13. Changes to these Terms

Field & Proof may update these Terms as the service changes. The version posted when you purchase will govern that purchase unless a change is required by law or you agree to the updated version. The current page will display its effective and last-updated dates.
